Nintendo and Amazon Sue for Millions of Dollars on Fake Amiibos

For more than a year, Nintendo and Amazon have been joint partners in lawsuits against sellers on Amazon’s website, who illegally sold fake Amiibos and Pirates’ Nintendo cartridges. Now, the two companies are asking the court to give a summary judgment on the offender, with a fine of $7 million.

pass PolygonsNintendo and Amazon reached a $7 million figure after calculating that seller groups had moved out at least $2,343,386 for fake Nintendo merchandise or games. Essentially, Nintendo and Amazon believe that both companies are hurt by the actions of these sellers, so triple the amount they earn is a reasonable response.

Nintendo and Amazon are aware of the seller’s true identity, but none of the organizations responded to the lawsuit or appeared in court to defend themselves. That's why the two companies' requirements for summary judgments may have a great chance. The lawsuit also believes that the fine will prevent others from trying to commit the same crime.

“This amount ($7 million) is conservative and is at the low end of the range of losses for the defendant's wrongdoing, but is important enough to provide a deterrent to future forgery,” Nintendo's lawyer wrote.

The Zelda project was cancelled and removed from Kickstarter, while Super Mario Supermarket owners were able to retain the name, in part because none of Nintendo's trademarks covered the supermarket.
