Fortnite is sued again at its item store

Fortnite has always been the subject of litigation Other regulatory actions Over the years, many times about its FOMO-powered store practice, now we have another one. According to reports Polygonsaiming at the “fake countdown timer”, it seems to indicate that an item is about to leave the store – even if it is often spent in a few days or weeks after the timer expires.
However, this lawsuit is not a problem with the Fortnite item store that exists today. The Dutch regulator took action due to the actions of the regulator and replaced the relevant timer in May last year, replacing it with a new disclaimer for each item in the store, announcing the exact date and time they will leave the store. Therefore, this lawsuit is about Epic's alleged past sins.
The Fortnite item store is a more vague place until 2024. Players are never told how long to stay in the store – when something appears, it may stay for a day, a week, or a month, but there is no definite way to know. Sometimes, the official Fortnite Twitter announces that it is leaving an item, but these warnings are usually issued hours before leaving.
Again, DatamIners can tell what parts will be there when the store resets – but until two hours ago. Most importantly, the only way to buy items is to actually get into the game, which makes it harder to make snapshot purchases and requires players to keep the game installed and updated just in case what they want returns.
Due to the actions taken in the Netherlands, these issues have been fixed in every item in the store in the game itself. Therefore, the new lawsuit is clearly aimed at damages, not the way the store works – according to the way the lawsuit is, the plaintiff is “a child who buys goods from the Epic store, and Epic promotes it with a misleading countdown timer”, while the proposed class is when Americans under 18 buy these times, and Americans under 18 have all appeared at these times.
However, the lawsuit is still at its earliest stages, so it may take some time to happen. Meanwhile, the FTC still plans to pay players as part of the player Its refund settlement with Epic. In 2023, the FTC imposed a huge fine, claiming that “illegal collection of players who do not need to buy, allowing children to file unauthorized charges without their parents’ permission and blocking some users who have illegal allegations of access to purchased content.”
